this is how the "right for private copies" is applied.
if you backup one of your DVDs, your original is scratched, you are allowed to use the your copy.
if you backup one of your DVDs, sell/give you original, this is piracy.
Same for the PS2 bios.
you are allowed to backup your own one as long as you still own the original one. (even if it's not available because your PS2 is broken)
