I have an i5 9600k cpu and I managed to set it so that it goes to 28-32FPS (software mode)
but why can't you fix the hardware mode?

28-32fps on that cpu is definitely not normal.
Did you tried the latest beta and when switching to software mode in GSdx,set rendering threads to lets say 3 for a start and also enable from the speed hacks MTVU(some games don't like that option so check if there is a speed boost or it works slower or don't boot at all)

thanks I have already tried and I have reached 32 FPS otherwise I go from 28-29FPS
on (3) balanced mode and 4 threads

You can also use gsdx HW hack "round sprite half" to get rid of upscaling lines.

preset: safe (defeault)
aspect ratio: 4:3
FMV aspect: 4:3

Gs plugin -you can set the Hack crc lv: automatic or full 


Rx5700xt !do not put aspect ratio 16:9! 
I'm an expert on this, it's just an AMD driver problem,
it's happened in the past with other games ...
the GPU goes crazy.
