FPS averages 60 in software and hardware mode in either dx9 or dx11
See through graphical glitch when racing and selecting vehicles
not fixable with any settings i try to use
tried every game fix every speedhack and every HW hack no luck
even tried disabling logarithm z in dx9 no luck

Did software mode also have the graphical bars ?

yes it did

only difference was in Hardware mode the race was darker then anything    

in software mode it was bright like in the screenshot

Then, just use the status playable. You can mention about the graphical glitches in the bugs you noticed while playing the game. As long as the game didn't crash and was able to enter past most scenes of the game, it's considered playable.
